Section 51 Manual

In terms of Section 51 of PAIA, private bodies are required to compile a manual containing information about the records held. This manual is available on request from our Information Officer.

Categories of Records Held

• Customer prescription records
• Chronic medication patient files
• Financial and accounting records
• Employee records
• Supplier and stock records
• Dispensing records as required by the Medicines Act

How to Request Access to Records

To request access to records, submit a written request to our Information Officer at the above address or via WhatsApp. Your request must include:

• Your full name and contact details
• Description of the record requested
• The form in which you require access
• Proof of identity

We will respond to your request within 30 days. The prescribed request form (Form C) is available from the South African Human Rights Commission at sahrc.org.za.

POPIA – Protection of Personal Information Act

Our Commitment

Laxmi Pharmacy is committed to processing personal information lawfully, in a reasonable manner that does not infringe on your privacy, as required by POPIA.

Conditions for Lawful Processing

We process personal information only when:

• You have given consent
• Processing is necessary to fulfil a contract with you
• Processing is required by law (e.g. prescription records)
• Processing protects your legitimate interests

Special Personal Information

Health and medical information is classified as special personal information under POPIA. We process this information only for the purpose of providing pharmaceutical care and dispensing medicines, and we obtain your explicit consent before doing so.

Your Rights Under POPIA

• Right to access: You may request details of the personal information we hold about you
• Right to correction: You may request that inaccurate information be corrected
• Right to deletion: You may request deletion of your information, subject to legal retention requirements
• Right to object: You may object to the processing of your information for direct marketing purposes
• Right to complain: You may lodge a complaint with the Information Regulator

Data Breach Notification

In the event of a data breach that is likely to affect you, we will notify you and the Information Regulator as soon as reasonably possible, in accordance with Section 22 of POPIA.
